Iran’s missile test does not violate UNSCR 2231

(Persia Digest) – An expert on international affairs in Tehran believes: “UNSCR 2231 does not prohibit missile tests by Iran. It is, in fact, the US who has abrogated the resolution by withdrawing from the 2015 JCPOA nuclear deal.”

Following allegations by the US about Iran’s missile test violating UNSCR 2231, France and Britain asked for a UNSC meeting with the US behind closed doors; but no joint statement was issued. Iranian authorities believe that Iran’s peaceful missile program does not violate any UN resolutions.

Expert on international affairs in Tehran, Hassan Beheshtipour, told Persia Digest (PD): “The JCPOA is covered by resolution 2231. When the US withdrew from the JCPOA, it abrogated the said resolution. But it is now citing the same resolution to announce that Iran must not test-fire its missiles. This is more of a joke. If the resolution must be implemented, the JCPOA is wholly covered by it and must also be implemented. The JCPOA accord cannot be separated from the resolution to suit oneself. This is against international law.”

He continued: “As such, US claims of Iran violating the UN resolution are invalid. In addition, it was the US who abrogated it first by withdrawing from the JCPOA accord.”

Speaking about Resolution 2231 and Iran’s missile test, he stated: “This clearly mentions that ‘Iran is called upon’, meaning no order has been issued. When an order is issued by a resolution, the word ‘shall’ is used. But in this one ‘Iran is called upon not to undertake any activity related to ballistic missiles designed to be capable of delivering nuclear weapons.’ Iran is not planning to have any nuclear weapons and has committed not to obtain them. Therefore, it has no reason to build missiles capable of delivering nuclear weapons.”

Beheshtipour reiterated: “At the same time, we are witness to London and Paris sending billions of dollars’ worth of armaments to countries such as Saudi Arabia to destabilize our region. How do they expect Iran - who cannot procure arms from them - to stop its deterrent programs? This approach by France and Britain is contrary to international norms.”

He underlined: “It must be noted that the US brought up the topic of Iran’s missile program and media propaganda as soon as it was announced that Germany will host EU’s SPV to work with Iran and its CEO will be from France. This simultaneity is obviously not accidental. The US is trying to stop the EU from working with Iran to implement the JCPOA. The recent UNSC meeting did not even issue a single statement. There seems to be a difference of opinion between western countries.”
